Please read carefully. NDVIP™, powered by ARVIS, is a non-clinical wellness and coaching membership. It is not medical advice, not a medical service, and not a substitute for care from your physician. It does not diagnose, treat, prescribe, or monitor any medical condition or medication. Results vary from person to person, and no particular outcome is promised or guaranteed. In an emergency, call 911.

1. Acceptance of these Terms

By creating an account, checking the acceptance boxes during enrollment, or using NDVIP (the “Service”), you agree to these Terms & Conditions and to our Privacy Notice. If you do not agree, do not enroll in or use the Service. You confirm that you are at least 18 years old and able to enter into this agreement.

2. What the Service is — and is not

The Service provides non-clinical, between-visit wellness support: automated check-ins by SMS and email, habit and progress tracking, behavioral encouragement, scoring summaries, progress reports, and SmartCare coordinator outreach. The Service is intended to support the “keep-it-off” maintenance phase of a wellness journey.

  • The Service is not medical, diagnostic, or therapeutic care.
  • It does not diagnose conditions, prescribe or adjust medication, or provide medical monitoring.
  • SmartCare coordinators provide encouragement and accountability only; they are not clinicians and do not provide medical advice.
  • All medical decisions remain between you and your own licensed healthcare provider.

3. No medical advice; results vary

Information provided through the Service is for general educational and wellness purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions about a medical condition, before starting any diet, exercise, or wellness program, and before making changes to any medication. Individual results vary, and NDVIP makes no representation, warranty, or guarantee regarding weight loss, weight maintenance, health, or any other outcome.

4. Membership, billing, and auto-renewal

The Service is offered as a paid monthly subscription. By enrolling you authorize NDVIP and its payment processor (Stripe) to charge your payment method.

  • Price. Membership is $29 per month. There is one membership and one price.
  • Auto-renewal. Unless you cancel, your membership renews automatically each month at the then-current rate, and your payment method is charged for each renewal.
  • Cancellation. You may cancel at any time, effective at the end of the current billing period. Cancellation stops future renewals.
  • Refunds. Except where required by law, payments are non-refundable, including for partially used periods. Billing receipts are provided after each charge.
  • Price changes. NDVIP may change pricing with reasonable advance notice.

5. SMS and email communications consent

By enrolling and providing your mobile number, you consent to receive recurring automated and non-automated text messages and emails from NDVIP related to your membership — including check-ins, reminders, weigh-in prompts, progress reports, and re-engagement messages. Message frequency varies.

Message and data rates may apply. You can opt out of SMS at any time by replying STOP, and obtain help by replying HELP. Consent to receive text messages is not a condition of any purchase. Mobile phone numbers and SMS consent are never shared with or sold to third parties or affiliates for marketing purposes. Carriers are not liable for delayed or undelivered messages. Opting out of SMS may limit core features of the Service.

6. Privacy and your data

Your use of the Service is also governed by the NDVIP Privacy Notice, which explains what information is collected, how it is used, and how it is protected. You retain ownership of the wellness information you provide, and it is shared only at your direction (for example, an optional progress summary to a provider you designate). Please review the Privacy Notice for details.

7. Your responsibilities

You agree to provide accurate information, to keep your account credentials secure, and to use the Service only for its intended personal wellness purpose. You are responsible for consulting your own healthcare providers about your health and for any decisions you make. You agree not to misuse, disrupt, or attempt to gain unauthorized access to the Service.

8. Not for emergencies

The Service is not designed for emergencies and is not monitored in real time. It will never contact emergency services on your behalf. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. If you are in emotional distress, contact a qualified professional or an appropriate crisis resource.

9. Disclaimers and limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, and including any warranty regarding health or weight outcomes. To the fullest extent permitted by law, NDVIP and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Changes to these Terms

NDVIP may update these Terms from time to time. Material changes will be communicated through the Service or by email, and the version and effective date above will be updated. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
